Part 1 — Terms of Sale
These terms of sale govern the sale of Jackdaw licences by Moose Softwares (SIREN 104 466 685) to consumers and professionals. Placing an order implies full acceptance of these terms.
Product and prices
Jackdaw is a downloadable macOS application. It is offered as a one-time perpetual licence (US$25), a monthly subscription (US$1) or a yearly subscription (US$10), following a 14-day free trial. Prices are shown in US dollars. Any applicable VAT is calculated and collected by Stripe at checkout, based on your country of residence.
Payment
Payment is processed securely by Stripe. Your licence is delivered electronically once payment is confirmed.
Right of withdrawal
For digital content supplied immediately, EU consumers are asked to expressly consent to immediate performance and to acknowledge that they thereby waive their 14-day right of withdrawal once the download or activation begins (Art. L.221-28 of the French Consumer Code). The 14-day free trial lets you evaluate Jackdaw fully before purchasing.
Legal guarantee of conformity
Consumers benefit from the statutory legal guarantee of conformity applicable to digital content (Art. L.217-3 et seq. of the French Consumer Code). This guarantee cannot be excluded. If Jackdaw does not conform, contact us and we will make it right.
Refunds
Within 14 days of purchase you can obtain a full, self-service refund directly in the app: open Jackdaw → Settings → Plan and choose “Request refund.” This immediately refunds your payment, cancels your licence and locks Pro features. After 14 days, or if you have any trouble, contact support.jackdaw@moose-softwares.com and we will review your request in good faith.
Governing law and dispute resolution
These terms are governed by French law. In case of a dispute, EU consumers may refer the matter to an accredited consumer mediator [TO COMPLETE: name and website of the accredited consumer mediator] and to the European Commission’s Online Dispute Resolution platform.
Part 2 — End-User Licence Agreement (EULA)
By installing or using Jackdaw you agree to this licence between you and Moose Softwares.
Licence grant
Subject to payment where applicable, we grant you a personal, non-exclusive, non-transferable licence to install and use Jackdaw on Macs that you own or control, for your own use.
Restrictions
- Do not redistribute, resell, rent or sublicense the software
- Do not reverse-engineer, decompile or disassemble it, except to the extent permitted by applicable law
- Do not remove or alter any proprietary notices
Ownership
Jackdaw is licensed, not sold. All intellectual-property rights remain with Moose Softwares.
Open-source components
Jackdaw includes third-party open-source software governed by its own licences, listed on our open-source credits page.
Warranty disclaimer and liability
Beyond the mandatory statutory guarantees described above, Jackdaw is provided “as is”. To the fullest extent permitted by law, our liability is limited to the amount you paid for the licence.
Termination
This licence ends automatically if you breach its terms. On termination you must stop using and delete the software.
